Ignorance or tricks of shia shaykh Ali al-Mohsen


Popular shia shaykh Ali al-Mohsen in his book “Masail hilafiya har fiha ahlasunnah” p 166, said:

الطائفة الخامسة: دلت على أن جلد شارب الخمر ثمانين جلدة استحدث بعد زمان النبي صلى الله

Translation:

Group five: (which) proves that lashing the wine drinker with 80 lashes was invented after the time of messenger (sallalahu)

Let us teach shia scholar as we are teaching shia laymen.

Muhadith of rafidah Hurr al-Amili in “Wasail ush-shia” 28/220, entitled chapter:

3 ـ باب أن حد الشرب ثمانون جلدة وإن شرب قليلا

3 – Chapter on that the hadd of drinking is eighty lashes, even if one drank (only) a little

[ 34603 ] 1 ـ محمد بن يعقوب ، عن علي بن إبراهيم ، عن محمد بن عيسى ، عن يونس ، عن أبي بصير ، عن أبي عبدالله ( عليه السلام ) قال : قلت له: كيف كان يجلد رسول الله ( صلى الله عليه وآله ) ؟ قال : فقال : كان يضرب بالنعال ويزيد كلما اتي بالشارب ، ثم لم يزل الناس يزيدون حتى وقف علىثمانين ، أشار بذلك علي ( عليه السلام ) على عمر فرضى بها .

1 – Muhammad b. Ya`qub from `Ali b. Ibrahim from Muhammad b. `Isa from Yunus from Abu Basir from Abu `Abdillah عليه السلام.  He said: I said to him: How did the Messenger of Allah صلى الله عليه وآله lash?  He said: He would strike by the sandals, and increase whenever he would be brought the drinker.  Then the people did not cease increasing until he halted upon eighty.  `Ali عليه السلام pointed that out to `Umar, so he accepted it.

[ 34604 ] 2 ـ وعن محمد بن يحيى ، عن أحمد بن محمد ، عن ابن فضال ، عن ابن بكير عن زرارة ، قال : سمعت أبا جعفر ( عليه السلام ) يقول : اقيمعبيد الله بن عمر وقد شرب الخمر فأمر به عمر أن يضرب ، فلم يتقدم عليه أحد يضربه حتى قام علي ( عليه السلام ) بنسعة مثنية لها طرفان ، فضربه بهاأربعين .

ورواه الشيخ بإسناده عن أحمد بن محمد والذي قبله بإسناده عن يونس مثله .

2 – And from Muhammad b. Yahya from Ahmad b. Muhammad from Ibn Faddal from Ibn Bukayr from Zurara.  He said: I heard Abu Ja`far عليه السلام saying: `Ubaydullah b. `Umar was determined to have drunken wine, so `Umar ordered that he be struck.  No one would advance upon him to strike him until `Ali عليه السلام rose up with a doubled-up (camel) thong which had two ends, so he struck him forty times with it.

And the Shaykh narrated it by his isnad from Ahmad b. Muhammad and the one before it by his isnad from Yunus likewise.

[ 34605 ] 3 ـ وعن علي بن إبراهيم ، عن أبيه ، عن ابن أبي عمير ، عن حماد بن عثمان ، عن الحلبي ، عن أبي عبدالله ( عليه السلام ) قال : قلت له :أرأيت النبي ( صلى الله عليه وآله ) كيف كان يضرب في الخمر ؟ قال : كان يضرب بالنعال ويزداد إذا اتي بالشارب ، ثم لم يزل الناس يزيدون حتى وقفذلك على ثمانين ، أشار بذلك علي ( عليه السلام ) على عمر فرضي بها .

ورواه الشيخ بإسناده عن علي بن إبراهيم مثله .

3 – And from `Ali b. Ibrahim from his father from Ibn Abi `Umayr from Hammad b. `Uthman from al-Halabi from Abu `Abdillah عليه السلام.  He said: I said to him: Have you seen how the Prophet صلى الله عليه وآله would strike for wine (drinking)?  He said: He would strike by the sandals and increase when he was brought the drinker.  Then the people did not cease increasing until he halted that upon eighty.  `Ali عليه السلام pointed that out to `Umar, so he was pleased by it.

And the Shaykh narrated it from `Ali b. Ibrahim likewise.

[ 34606 ] 4 ـ وعنه ، عن محمد بن عيسى ، عن يونس ، عن زرارة ، عن أبي جعفر ( عليه السلام ) قال : قال : إن عليا ( عليه السلام ) كان يقول :الرجل إذا شرب الخمر سكر ، وإذا سكر هذى ، وإذا هذى افترى ، فاجلدوه حد المفتري .

ورواه المفيد في ( الارشاد ) مرسلا نحوه .

4 – And from him from Muhammad b. `Isa from Yunus from Zurara from Abu Ja`far عليه السلام.  He said: He said: Verily `Ali عليه السلام would say: The man when he has drunken wine becomes drunk, and when he has become drunk he raves, and when he raves he slanders, so lash him by the hadd of the slanderer.

And al-Mufid narrated it in al-Irshad likewise in a mursal fashion.

 [ 34607 ] 5 ـ وبالإسناد عن يونس ، عن عبدالله بن سنان ، قال : قال أبو عبدالله ( عليه السلام ) : الحد في الخمر أن يشرب منها قليلا أو كثيرا ، ثم قال: اتي عمر بقدامة بن مظعون وقد شرب الخمر وقامت عليه البينة ، فسأل عليا ( عليه السلام ) فأمره أن يجلده ثمانين ، فقال قدامة : يا أمير المؤمنين ليسعلى حد ، أنامن أهل هذه الآية ( ليس على الذين آمنوا وعملوا الصالحات جناح فيما طعموا ) فقال علي ( عليه السلام ) : لست من أهلها إن طعام أهلها لهمحلال ليس يأكلون ولا يشربون إلا ما أحل الله لهم ، ثم قال ( عليه السلام ) : إن الشارب إذا شرب لم يدر ما يأكل ولا ما يشرب ، فاجلدوه ثمانين جلدة .

 محمد بن الحسن بإسناده عن يونس مثله ، وكذا الذي قبله .

 ورواه الصدوق في ( العلل ) مرسلا .

5 – And by the isnad from Yunus from `Abdullah b. Sinan.  He said: Abu `Abdillah عليه السلام said: The hadd in wine is (whether) one drinks a little of it or a lot.  Then he said: `Umar was brought Qudama b. Mazh`un, and he had drunk wine and the evidence was established against him.  So he asked `Ali عليه السلام and he commanded him to lash him eighty (times).  So Qudama said: O Amir al-Mu’mineen, there is no hadd upon me.  I am from the people of this ayat ““There is no fault in those who believe and do deeds of righteousness what they may eat”.  So `Ali عليه السلام said: You are not from its people.  Verily the food of its people is halal for them, not eating and not drinking but what Allah has made halal for them.  Then he عليه السلام said: Verily when the drinker drinks, he does not know what he is eating or what he is drinking.  So lash him with eighty lashes.

Muhammad b. al-Hasan by his isnad from Yunus likewise, and thusly the one prior to it.

And as-Saduq narrated it in al-`Ilal in a mursal fashion.

 [ 34608 ] 6 ـ وبإسناده عن محمد بن أحمد بن أبي عبدالله الرازي ، عن الحسن بن علي بن أبي حمزة ، عن أبي عبدالله المؤمن ، عن إسحاق بن عمار ،قال : قلت لأبي عبدالله ( عليه السلام ) : الزنا شر ، أو شرب الخمر ؟ وكيف صار في الخمر ثمانون ؟ وفي الزنا مائة ؟ فقال : يا إسحاق الحد واحد ولكنزيد في هذا لتضييعه النطفة ولوضعه إياها في غير موضعها الذي أمر الله به .

 ورواه الكليني عن محمد بن يحيى ، عن أحمد بن محمد مثله .

 ورواه الصدوق كما مرّ .

6 – And by his isnad from Muhammad b. Ahmad b. Abi `Abdillah ar-Razi from al-Hasan b. `Ali b. Abi Hamza from Abu `Abdillah al-Mu’min from Ishaq b. `Ammar.  He said: I said to Abu `Abdillah عليه السلام: Is fornication worse or drinking wine?  And how did (the hadd) in wine become eighty (lashes) while in fornication it is a hundred?  So he said: O Ishaq, the hadd is the same (lit. one), however this was increased due to his squandering of the nutfa (sperm) and his putting of it in other than its place which Allah has commanded.

And al-Kulayni narrated it from Muhammad b. Yahya from Ahmad b. Muhammad likewise.

And as-Saduq narrated it as has passed.

 [ 34609 ] 7 ـ محمد بن علي بن الحسين في ( العلل ) عن محمد بن موسى بن المتوكل ، عن إسحاق بن عمار ، قال : سألت أبا عبدالله ( عليه السلام )عن رجل شرب حسوة خمر ، قال : يجلد ثمانين جلدة قليلها وكثيرها حرام .

7 – Muhammad b. `Ali b. al-Husayn in al-`Ilal from Muhammad b. Musa b. al-Mutawakkil from Ishaq b. `Ammar.  He said: I asked Abu `Abdillah عليه السلام about a man who drank a sip of wine.  He said: He is lashed eighty lashes.  A little of it and a lot of it are haram.

 [ 34610 ] 8 ـ وفي ( الخصال ) عن رافع بن عبدالله ، عن يوسف بن موسى ، عن يحيى بن عثمان ، عن أبيه ، عن أبي لهيعة ، عن خالد بن يزيد ، عنسعيد بن أبي هلال ، عن نبيه بن وهب ، عن محمد ابن الحنفية ، عن أبيه علي بن أبي طالب ( عليه السلام ) ، أن رسول الله ( صلى الله عليه وآله ) ضربفي الخمر ثمانين .

8 – And in al-Khisal from Rafi` b. `Abdullah from Yusuf b. Musa from Yahya b. `Uthman from his father from Lahi`a from Khalid b. Yazid from Sa`id b. Abi Hilal from Nubih b. Wahb from Muhammad b. al-Hanafiyya from his father `Ali b. Abi Talib عليه السلام that the Messenger of Allah صلى الله عليه وآله struck eighty (lashes) in regards to wine.

So how is it possible that shia shaykh is not aware about such reports in their own book?
