‘Ali (ra) drops the punishment & the Prophet (saw) orders not to drop it


al-Salamu ‘Aleykum,

Before we begin the word “Hadd” means Islamic punishment, such as lashing the adulterer and cutting the hand of the thief ect…

In al-Kafi vol.7 pg.254:

مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ سَلَمَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ كَانَ أُسَامَةُ بْنُ زَيْدٍ يَشْفَعُ فِي الشَّيْ‏ءِ الَّذِي لَا حَدَّ فِيهِ فَأُتِيَ رَسُولُ اللَّهِ ( صلى الله عليه وآله ) بِإِنْسَانٍ قَدْ وَجَبَ عَلَيْهِ حَدٌّ فَشَفَعَ لَهُ أُسَامَةُ فَقَالَ لَهُ رَسُولُ اللَّهِ ( صلى الله عليه وآله ) لَا يُشَفَّعُ فِي حَدٍّ .

…Abban bin ‘Uhman from Salamah from abu ‘Abdullah (as): Usama bin Zaid used to ask for the forgiveness in the matter in which there is no Hadd(islamic punishment), so a man was once brought to the Prophet (SAWS) and he committed a matter that required Hadd(islamic punishment), so (as usual) Usama interceded and asked for him to be forgiven but the Prophet (SAWS) said: “There is no intercession when a matter requires Hadd.”

Grading: Behbudi said “Sahih” 3/323.

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى وَ عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ كَانَ لِأُمِّ سَلَمَةَ زَوْجَةِ النَّبِيِّ ( صلى الله عليه وآله ) أَمَةٌ فَسَرَقَتْ مِنْ قَوْمٍ فَأُتِيَ بِهَا النَّبِيُّ ( صلى الله عليه وآله ) فَكَلَّمَتْهُ أُمُّ سَلَمَةَ فِيهَا فَقَالَ النَّبِيُّ ( صلى الله عليه وآله ) يَا أُمَّ سَلَمَةَ هَذَا حَدٌّ مِنْ حُدُودِ اللَّهِ عَزَّ وَ جَلَّ لَا يُضَيَّعُ فَقَطَعَهَا رَسُولُ اللَّهِ ( صلى الله عليه وآله ) .

…Ahmad bin Muhammad bin ‘Isa and ‘Ali bin Ibrahim from his father … from Muhammad bin Qays from abu Ja’far (as) that he said: Umm Salamah the wife of the Prophet (SAWS) had a female servant, this servant stole from some people so she was brought to the Prophet (SAWS), Umm Salamah spoke to the Prophet (SAWS) about her (in order to get her released) but the Prophet (SAWS) said: “O Umm Salamah, This is a Hadd from the laws of Allah almighty, it cannot be cancelled.” So he cut her hand.

Grading: Majlisi said: “Like Sahih” 23/394.

As opposed to the above we read in al-Kafi vol.7 pg.201:

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنْ مَالِكِ بْنِ عَطِيَّةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ بَيْنَا أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) فِي مَلَإٍ مِنْ أَصْحَابِهِ إِذْ أَتَاهُ رَجُلٌ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي قَدْ أَوْقَبْتُ عَلَى غُلَامٍ فَطَهِّرْنِي فَقَالَ لَهُ يَا هَذَا امْضِ إِلَى مَنْزِلِكَ لَعَلَّ مِرَاراً هَاجَ بِكَ فَلَمَّا كَانَ مِنْ غَدٍ عَادَ إِلَيْهِ فَقَالَ لَهُ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي أَوْقَبْتُ عَلَى غُلَامٍ فَطَهِّرْنِي فَقَالَ لَهُ يَا هَذَا امْضِ إِلَى مَنْزِلِكَ لَعَلَّ مِرَاراً هَاجَ بِكَ حَتَّى فَعَلَ ذَلِكَ ثَلَاثاً بَعْدَ مَرَّتِهِ الْأُولَى فَلَمَّا كَانَ فِي الرَّابِعَةِ قَالَ لَهُ يَا هَذَا إِنَّ رَسُولَ اللَّهِ ( صلى الله عليه وآله ) حَكَمَ فِي مِثْلِكَ بِثَلَاثَةِ أَحْكَامٍ فَاخْتَرْ أَيَّهُنَّ شِئْتَ قَالَ وَ مَا هُنَّ يَا أَمِيرَ الْمُؤْمِنِينَ قَالَ ضَرْبَةٌ بِالسَّيْفِ فِي عُنُقِكَ بَالِغَةً مَا بَلَغَتْ أَوْ إِهْدَاءٌ مِنْ جَبَلٍ مَشْدُودَ الْيَدَيْنِ وَ الرِّجْلَيْنِ أَوْ إِحْرَاقٌ بِالنَّارِ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ أَيُّهُنَّ أَشَدُّ عَلَيَّ قَالَ الْإِحْرَاقُ بِالنَّارِ قَالَ فَإِنِّي قَدِ اخْتَرْتُهَا يَا أَمِيرَ الْمُؤْمِنِينَ قَالَ خُذْ لِذَلِكَ أُهْبَتَكَ فَقَالَ نَعَمْ فَقَالَ فَصَلَّى رَكْعَتَيْنِ ثُمَّ جَلَسَ فِي تَشَهُّدِهِ فَقَالَ اللَّهُمَّ إِنِّي قَدْ أَتَيْتُ مِنَ الذَّنْبِ مَا قَدْ عَلِمْتَهُ وَ إِنِّي تَخَوَّفْتُ مِنْ ذَلِكَ فَجِئْتُ إِلَى وَصِيِّ رَسُولِكَ وَ ابْنِ عَمِّ نَبِيِّكَ فَسَأَلْتُهُ أَنْ يُطَهِّرَنِي فَخَيَّرَنِي بَيْنَ ثَلَاثَةِ أَصْنَافٍ مِنَ الْعَذَابِ اللَّهُمَّ فَإِنِّي قَدِ اخْتَرْتُ أَشَدَّهَا اللَّهُمَّ فَإِنِّي أَسْأَلُكَ أَنْ تَجْعَلَ ذَلِكَ كَفَّارَةً لِذُنُوبِي وَ أَنْ لَا تُحْرِقَنِي بِنَارِكَ فِي آخِرَتِي ثُمَّ قَامَ وَ هُوَ بَاكٍ حَتَّى جَلَسَ فِي الْحُفْرَةِ الَّتِي حَفَرَهَا لَهُ أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) وَ هُوَ يَرَى النَّارَ تَتَأَجَّجُ حَوْلَهُ قَالَ فَبَكَى أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) وَ بَكَى أَصْحَابُهُ جَمِيعاً فَقَالَ لَهُ أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) قُمْ يَا هَذَا فَقَدْ أَبْكَيْتَ مَلَائِكَةَ السَّمَاءِ وَ مَلَائِكَةَ الْأَرْضِ فَإِنَّ اللَّهَ قَدْ تَابَ عَلَيْكَ فَقُمْ وَ لَا تُعَاوِدَنَّ شَيْئاً مِمَّا قَدْ فَعَلْتَ .

In a very long Hadith a man comes to Ameer al-Mumineen ‘Ali (ra) and says that he has entered inside a young boy, but ‘Ali (ra) releases him, the next day he comes and says the same thing and ‘Ali (ra) let’s him go, and finally on the fourth time ‘Ali (ra) says:

[The Prophet (SAWS) has decided three rulings for your case, pick whichever you like, the man said: “What are they O Ameer al-Mumineen?” He (as) said: “To be struck by a sword on your neck, to be thrown from the top of a mountain with your hands and feet tied, or to be burned by fire.” he said: “Which is the harshest of them?” he (as) said: “to be burned by fire.” he said: “Then I pick this one O Ameer al-Mumineen.” ‘Ali said: “Then prepare yourself for it.” so he prayed two Raka’at and sat down in Tashahhud and said: “O Allah I have committed what you know from sins, and I feared this so I came to the successor and cousin of your Prophet (SAWS) and asked him to purify me so he gave me three choices and I picked the harshest so that you may forgive my sins through it and not burn me with your fire on judgement day.” So he stood up while crying and sat in the hole that ‘Ali (as) had dug for him and he saw the scorching fires around him, so Ameer al-Mumineen (as) cried and his companions all cried and he told him: “You! stand up, you have made the angels of the heavens and the earth cry, Allah has forgiven you your sins so go and do not return to doing what you did again.”]

Grading: Majlisi said “Hassan” because of Ibrahim bin Hashim but it’s actually “Sahih” (Miraat 23/306).

Now reconcile or weaken or whatever you wanna do.

  1. Assalamun Alaykum, the way I see it is that the man mentioned in the third narration genuinely seeked forgiveness for his sin therefore he was released as Hazrat Ali AS saw his sincerity. In the first and second narrations the punishment was given as the persons committing the crime had no sincere repentance. Instead others came on there behalf. The Quran mentions many times that Allah SWT is all merciful and that punishment is only given to those who do not repent.
